Product Warranty, Return Policy and Liability

Warranty

E2 Systems, Inc. ("E2") warrants that the media upon which Exercise Explorer ("the Program") is distributed is free from defects in materials and workmanship under normal use for a period of thirty (30) days from the date of purchase. E2 will replace the media upon return of the defective media. E2 does not warrant that the operation of the Program will be error free or that the Program will meet your requirements. E2 will provide free updates for a year with our professional products in an effort to correct any errors in our control, and to add new features. Further, after this period, E2 will periodically release upgrades and improvements in the Program, which there may be a charge for.

Return Policy

E2 does not accept returns on opened or installed media (except as described below). Any product shipped may be returned for a full refund provided the product has not been opened, and a return is requested within a period of thirty (30) days from the date of purchase. A software license agreement and an agreement to participate must be accepted before the Program is opened and installed. If you do not accept these agreements, return the unopened Program. All returns must first be authorized by contacting E2 by mail, or e-mail at techsupport@exercise-explorer.com.

Our software, once purchased, needs to be registered. Without registering, the software is fully functional for a limited time. During this period, if you determine the software is not what you want, simply call or e-mail us to return the software, and receive a refund of the full purchase price (less shipping and an 8% re-stocking charge). Special pricing, promotions, and group purchases are not eligible. Once the software has been registered, it may not be returned.

Limited Liability

Under no circumstances will E2 be liable to you for any special, consequential, indirect or similar damages (inclusive of medical injuries) stemming from the use of the Program, including any lost profit or data arising out of the use of the Program or inability to use the Program even if E2 has been notified of the possibility of such damages. Some states disallow the limitation of exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no case shall E2's liability exceed the purchase price of the Program.

These limitations shall apply regardless of whether you accept the Program.
